Albania adopts new law on patents, utility models and SPCs

During July 2025 the Albanian Parliament passed new law no. 53/2025 on patents, utility models and supplementary protection certificates.


The new law aims to fully approximate the Albania legislation on patents, utility models and SPCs with a number of EU legal acts, including Directive 98/44, Directive 2004/48, Regulation 816/2006, Regulation 469/2009, Regulation 2019/933, Regulation 1610/96, Regulation 1901/2006.


The law further repels a number of the relevant provisions of the existing law no. 9947/2008 on industrial property dealing with patents, utility models and SPCs.

The new law has been published in the Albanian Official Gazette no. 138, dated 01/08/2025, and enters into effect 15 days after the date of publication.


However, the new secondary legislation to implement the new legal provisions is required to be adopted by decision of the Council of Ministers within a period of 9 months of the effective date of the new law.


Therefore, until new secondary legislation is approved by the Council of Ministers, the existing secondary legislation, including rules of procedure, fees and rules on authorized

IP attorneys will continue to be applied.


Infringement procedures as well as administrative procedures regarding patents, utility models and SPCs, which have been started prior to the effective date of the new law will continue to be treated and resolved on the basis of rules precisely in force.
